Terms of Use
These are the rules for using Giva. You accept them when you create an account, and they sit alongside our Privacy Policy and CFT/AML Policy.

1. About these Terms
These Terms of Use (“Terms”) govern your access to and use of the Giva mobile application, the usegiva.com website and every related service we provide (together, the “Services”). Giva is a crypto off-ramp and payments product built for people and businesses in Nigeria.
By creating a Giva account, ticking the acceptance box at sign-up, or otherwise using the Services, you confirm that you have read, understood and agreed to these Terms, our Privacy Policy and our CFT/AML Policy. If you do not agree, please do not use Giva.
We may update these Terms as our product, partners or the law change. Where a change is material, we will notify you in the app or by email before it takes effect. Continuing to use Giva after that date means you accept the updated Terms.
2. Eligibility and your account
To use Giva you must:
- be at least 18 years old and legally able to enter into a binding contract;
- register in your own name and never on behalf of another person without our written consent;
- provide accurate, current and complete information during sign-up and keep it up to date;
- complete identity verification (KYC) to the level required for the features and limits you want to use; and
- not be a resident of, or acting on behalf of anyone in, a country or on a sanctions list that we are prohibited from serving.
One person may hold one personal account. You are responsible for everything that happens under your account, including keeping your password, PIN, device and one-time codes secure. Tell us immediately at hello@usegiva.com if you suspect unauthorised access.
3. Verification and limits
Before you can transact, we are required to verify who you are. Depending on your verification tier, this may include your legal name, date of birth, BVN or NIN, a government-issued ID, a selfie or liveness check, and proof of address or source of funds.
Your transaction limits depend on your verification tier and are shown in the app before you confirm any transaction. We may request additional information at any time, and we may pause an account or a transaction while verification is pending.
4. The Services we provide
Through Giva you can:
- deposit supported digital assets into wallet addresses generated for your account;
- buy and sell supported digital assets at the rate quoted to you at the time of the order;
- convert digital assets into Naira and withdraw to any Nigerian bank account;
- deposit Naira and hold a Naira balance with our licensed banking partners;
- send value to other Giva users; and
- pay for airtime, data, electricity and TV subscriptions from your balance.
Giva is a technology platform. Fiat accounts, card rails and bill payments are delivered together with licensed partners, and digital-asset liquidity is sourced from institutional counterparties. We may add, change, suspend or withdraw features, assets or networks at any time — for example where a network is unstable, an asset is delisted, or a partner changes its requirements.
5. Transactions, rates and fees
Rates shown in the app are derived from live market data and partner liquidity and are valid only for the short quote window displayed on screen. Once you confirm a transaction, it is final and cannot be recalled, reversed or cancelled by you.
All applicable fees and the exact amount you will receive are shown before you confirm. We do not charge hidden spreads. Network (gas) fees charged by a blockchain are outside our control and are passed on to you as displayed.
You are responsible for entering the correct wallet address, network, bank account number and biller details. Sending an asset over the wrong network, or to an address or account you entered incorrectly, may result in permanent loss that we cannot recover.
Processing times are usually near-instant, but settlement can be delayed by blockchain congestion, bank downtime, biller downtime or compliance review.
6. Risk disclosure
Digital assets are volatile. Prices can move sharply in either direction and you may receive less Naira than you expected between the moment you decide to transact and the moment you confirm. Giva does not provide investment, tax or legal advice, and nothing in the app is a recommendation to buy or sell any asset.
You should only transact with funds you can afford to put at risk, and you remain responsible for assessing whether a transaction is suitable for you.
7. Acceptable use
You agree not to use Giva to:
- launder money, finance terrorism or proliferation, or move the proceeds of crime;
- commit or facilitate fraud, including romance scams, phishing, or receiving funds obtained by deception;
- trade on behalf of an undisclosed third party, or operate an unlicensed exchange, bureau de change or P2P desk through your account;
- evade sanctions, capital controls or tax obligations;
- interact with mixers, darknet markets, gambling operations or wallets flagged for illicit activity;
- abuse, reverse-engineer, scrape, overload or attempt to gain unauthorised access to the Services; or
- provide false, forged or borrowed identity documents.
Breaching this section may lead to immediate suspension, freezing of balances, reporting to the relevant authorities, and permanent closure of your account.
8. Suspension, freezing and closure
We may suspend or restrict your account, hold a transaction, or freeze funds where we reasonably believe it is necessary to comply with the law, to complete a compliance review, to protect you or another user from fraud, or where a partner, court or regulator directs us to.
Where we are legally permitted to do so, we will tell you what is happening and what we need from you. We will not always be able to explain the reason for a report or a freeze.
You can close your account at any time from Settings, provided your balance is zero and no transaction, dispute or investigation is outstanding. We may close your account with reasonable notice, or immediately where required by law or by a breach of these Terms.
9. Liability
We provide the Services with reasonable care and skill, but we do not guarantee uninterrupted or error-free access. To the fullest extent permitted by Nigerian law, Giva is not liable for market losses, losses caused by details you entered incorrectly, blockchain or bank network failures, or events outside our reasonable control.
Nothing in these Terms limits our liability for fraud or for anything that cannot be limited by law.
10. Complaints and governing law
If something goes wrong, contact us first at hello@usegiva.com with your account details and the transaction reference. We aim to acknowledge complaints within one business day and to resolve them within a reasonable period.
These Terms are governed by the laws of the Federal Republic of Nigeria, and the courts of Nigeria have jurisdiction over any dispute that cannot be resolved between us.
